Single party consent audio recording laws

by: Hbo

According to Ala. Code § 13A-11-30 you are not allowed to video record people in “A place where one may reasonably expect to be safe from casual or hostile intrusion or surveillance, but such term does not include a place to which the public or a substantial group of the public has access”.
I live in my sorority house and I expect to not be under surveillance there. The public does not have access to my house, we invite PNMs in during rounds. So any recording rumors if true are def sketchy and could face legal penalties from HQs big bag legal team.

Alabama is a public school, state run. The buildings are public property.

Ok so I’m gonna go into every dorm room on campus and just start recording?? That’s pushing the definition of “public property”.

The sorority houses are def not public property. They are built with private sorority money and the public have no access to them without invitation.

It’s not your house, it’s owned by the university.

The university has a say whether or not to allow them to record. They don’t need your permission if the person recording is part of the conversation being recorded.

alabama like almost every other university out there has codes of conduct we all sign. From that code of conduct “Invasion of another’s privacy, where that person has a reasonable expectation of privacy, including, but not limited to, creating, making, possessing, storing, sharing, or distributing unauthorized audio, video, digital, or photographic images of a person taken in a location in which that person has a reasonable expectation of privacy.”

Are you stupid? People are saying hbo is sending in mic’d up PNMs (Bama students) into houses. Those PNMs would be the ones violating the code of conduct.
It doesn’t matter it’s all a big lie made up to prank the Tt people and they def fell for it.

the houses are actually bought and rented out by the National alumni association, at least for a couple houses that I know. The alumni lease it to the chapter. It’s on university grounds, but it is not owned by the university

That show will be terrible. “We sent in an 18 year old to listen to what a 20 year old had to say to her…and they talked about camp and how they’re excited for football season….the end”.

Clearly Any of bamas film or journalism majors need to step up their learning here because the hoops that anyone would need to go to record audio, let alone film people, with no consent (legal or not) and try to pull a coherent product out that would just be insane. This is not how documentary production works. It is much more likely that it’s again the local news or even national news as a fluff piece is getting in on the action like they always did even pre rushtok.

Nationals should send a seize and desist. A lawsuit after won’t do anything for the damage

You mean CEASE and desist.

There are so many obvious holes in the microphone rumors and film crew rumors. Like they see a guy from AL.com shooting photos for their news stories they do every year and suddenly that’s what qualifies as an hbo/Netflix film? Sheesh

Shows or films about sororities have always been big nothingburgers. No one would waste $ on this. Not to mention Bama and NPC would never sign off on agreeing to this. Tiktok we got you fooled this is how we know who is actually on campus and who isn’t.

I do not understand how a PNM can record a convo without my consent

By: How?
by: Gg

It’s a messed up law. As long as one person in a convo consents it can be recorded, but that applies to like being in a public place. It’s used to like secret shopping cases catching workers who are like stealing and stuff usually. If you’re in your apartment with a roommate though it gets sketchy because in your place of residence you assume you have privacy.
That’s why it doesn’t make sense that anyone individually or as a production company would risk something like this.
